What can go wrong?

Without a valid Will in place no one has the legal authority to deal with your affairs and arrangements. In those circumstances it may be necessary to make an application to the Supreme Court by an eligible person (e.g. your spouse, children, parents, siblings) to be appointed as the Administrator of your estate which will enable that person to finalise your affairs – including arranging your funeral. The Court has a priority ranking of who is eligible to apply. That person may not be the person that you would want to be making these decisions.

DO YOU WANT THE STATE TO DECIDE WHAT HAPPENS TO YOUR ASSETS WHEN YOU DIE?

In addition to those complexities (and associated costs for that person to be appointed) you are leaving it to State legislation to decide who receives your life’s hard work.

Without a valid Will and more importantly a holistic estate plan (including looking at the impact of taxes payable on your superannuation death benefit) your loved ones may be left without access to funds, property, super, life insurances, etc for many months.

WILL YOUR FAMILY BE ABLE TO SURVIVE FOR MONTHS WITHOUT ACCESS TO THESE ASSETS?

When they finally get access or authority to deal with your assets and affairs they will be bound to follow the intestacy rules. In Queensland this means that if you have a spouse and children – your spouse will not receive the entirety of your estate but rather it will be allocated in accordance with those rules in various percentages.
